Terms of Use

Welcome to Y FIT. These Terms govern your use of the Y FIT member app, the Y FIT Admin app and the website yfit.online (together, the "Services"), provided by the Y FIT gym ("the Club", "we"). By using or signing in to the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility

The Services are intended for Club members and staff. You must be at least 16, or use the Services with the consent of a parent or guardian who accepts these Terms on your behalf.

2. Account and security

• Your account is created by the Club with your phone number; you choose a password at first sign-in.
• You are responsible for keeping your password confidential and for all activity under your account.
• Accounts are personal and may not be shared or transferred.
• Information you provide must be accurate and up to date.
• Notify the Club immediately of any suspected unauthorised use.

3. Membership, subscriptions and payments

• Subscription types, prices, durations, freezing and refunds follow the Club's published rules, which may change from time to time without affecting a paid, active subscription.
• After expiry, access to some app sections may be limited until renewal.
• Unpaid amounts are recorded as a balance and settled as agreed with the Club.
• Financial records in the app are for reference; in case of discrepancy, the Club's official receipts and records prevail.

4. Health disclaimer

Training and nutrition plans, exercise guides and animations, goals and nutritional calculations are general guidance only and do not constitute medical advice, diagnosis or treatment.

• Consult a qualified physician before starting any exercise or diet program, especially if you have a medical condition, injury, are pregnant or take medication.
• Stop exercising immediately and seek help if you feel pain, dizziness or shortness of breath.
• You exercise voluntarily and are responsible for performing exercises correctly and safely and for asking a coach for help when needed.

5. Club rules and safety

Your use of the Club's facilities is subject to its internal rules and staff instructions. These Terms supplement, and do not replace, those rules.

6. Acceptable use

You agree not to: use the Services unlawfully or in breach of these Terms; attempt to access other users' accounts or data or bypass security; disrupt or overload the Services or introduce malicious code; copy, modify, republish or sell content, or reverse-engineer the app; or impersonate others or provide misleading information.

7. Your content

You retain ownership of the data and content you enter, such as measurements, logs and your photo, and grant the Club permission to use it only to provide the Services to you under the Privacy Policy.

8. Intellectual property

The Services, their design, the Y FIT name and logo, text and interfaces are owned by or licensed to the Club. Exercise animations are used under license. These Terms grant you no right to use these elements outside the Services.

9. Third-party services

The Services rely on external providers such as Google Firebase and Cloudflare and may link to other services. We are not responsible for their content or policies.

10. Availability, updates and offline use

• We aim for continuous availability but do not guarantee error-free or uninterrupted operation; the Services may be paused for maintenance.
• The app updates automatically in the background; features may be added, changed or removed.
• The app works offline and sends changes when the connection returns. In rare cases where the same data is edited on two offline devices, the last change received prevails.

11. Staff and the Admin app

Staff must use the Admin app only within their permissions, keep members' data confidential, and not use it for any purpose outside their work at the Club. Important staff actions are recorded in an internal activity log.

12. Suspension and termination

The Club may suspend or terminate your account for breach of these Terms or Club rules, or when your membership ends. You may request deletion of your account at any time via the Delete account page.

13. Disclaimer of warranties

To the extent permitted by law, the Services are provided "as is" and "as available", without warranties of fitness for a particular purpose or of specific results.

14. Limitation of liability

To the maximum extent permitted by law, the Club is not liable for indirect, incidental or consequential damages arising from the use of or inability to use the Services. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to indemnify the Club against claims arising from your breach of these Terms or misuse of the Services.

16. Governing law

These Terms are governed by the laws of the country in which the Club operates. We aim to resolve any dispute amicably first by contacting Club management.

17. Changes

We may amend these Terms and will announce material changes in the app. Continued use after a change takes effect constitutes acceptance.

18. General

If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to exercise a right is not a waiver of it.
